Патентный закон. Статья 3.Правовая охрана изобретения, полезной модели, промышленного образца
Права на изобретение, полезную модель, промышленный образец охраняются законом и подтверждаются соответственно патентом на изобретение, патентом на полезную модель и патентом на промышленный образец.
Патент удостоверяет приоритет, авторство изобретения, полезной модели или промышленного образца и исключительное право на изобретение, полезную модель или промышленный образец.
Патент на изобретение действует до истечения двадцати лет с даты подачи заявки в федеральный орган исполнительной власти по интеллектуальной собственности.
Срок действия патента на изобретение, относящееся к лекарственному средству, пестициду или агрохимикату, для применения которых требуется получение в установленном законом порядке разрешения, продлевается федеральным органом исполнительной власти по интеллектуальной собственности по ходатайству патентообладателя на срок, исчисляемый с даты подачи заявки на изобретение до даты получения первого такого разрешения на применение, за вычетом пяти лет. При этом срок, на который продлевается действие патента на изобретение, не может превышать пять лет. Указанное ходатайство подается в период действия патента до истечения шести месяцев с даты получения такого разрешения или даты выдачи патента в зависимости от того, какой из этих сроков истекает позднее.
Патент на полезную модель действует до истечения пяти лет с даты подачи заявки в федеральный орган исполнительной власти по интеллектуальной собственности. Срок действия патента на полезную модель может быть продлен федеральным органом исполнительной власти по интеллектуальной собственности по ходатайству патентообладателя, но не более чем на три года.
Патент на промышленный образец действует до истечения десяти лет с даты подачи заявки в федеральный орган исполнительной власти по интеллектуальной собственности. Срок действия патента на промышленный образец может быть продлен федеральным органом исполнительной власти по интеллектуальной собственности по ходатайству патентообладателя, но не более чем на пять лет.
При исчислении указанных в настоящем пункте сроков действия патентов на изобретение, полезную модель, промышленный образец, выданных по выделенным заявкам, датой подачи заявки считается дата подачи первоначальной заявки в федеральный орган исполнительной власти по интеллектуальной собственности.
Объем правовой охраны, предоставляемой патентом на изобретение или полезную модель, определяется их формулой. Для толкования формулы изобретения и формулы полезной модели могут использоваться описание и чертежи.
Объем правовой охраны, предоставляемой патентом на промышленный образец, определяется совокупностью его существенных признаков, нашедших отражение на изображениях изделия и приведенных в перечне существенных признаков промышленного образца.
Положения настоящего Закона распространяются на секретные изобретения (изобретения, содержащие сведения, составляющие государственную тайну) с особенностями их правовой охраны и использования, установленными в разделе VII настоящего Закона.
Правовая охрана в соответствии с настоящим Законом не предоставляется полезным моделям и промышленным образцам, содержащим сведения, составляющие государственную тайну.
Car Design Glossary
Airdam: A foil or aerodynamic device, often positioned under the front bumper.
A-pillar: The first set of structural roof supports at either side of the windshield. The next set of pillars, behind the front doors, is called B-pillars, and those behind the rear doors are called C-pillars. Some limousines and station wagons have D-pillars.
Alloy wheel: A wheel cast from alloys of aluminum or magnesium, usually in one piece. (See also “Disc wheel” and “Wire wheel.”)
Applied (fender or trim): Fastened onto or stamped into the surface of the body.
Armature: The wooden, metal or hard-foam supporting structure under a clay model.
Attitude: When a vehicle has a noticeable demeanor and is said to be aggressive, playful, intimidating etc. Can also describe the vehicles overall relationship to the ground.
Axes: In locating points on a car body, designers and draftsmen use the conventional three 3D reference lines: longitudinal, vertical and cross-car. These lines or axes are labeled X-Y-Z. (See also “Zero point.”)
Backlight: The rear window opposite the windshield.
Badge engineering: The practice of applying different nameplates to cars with identical or very similar sheetmetal.
Bakeoff: A showdown between design proposals, usually held in the form of a show with clay models from rival studios or designers.
“Banana”: The opening between the top of the steering-wheel rim and the hub through which the driver can see the instrument panel.
Bead or beading: A formed, often ornamental molding, usually pliable, sometimes fitted as a sealer (“welting”) between two exterior body panels; e.g. between fenders and body. May also be rigid as in “fender beading”. Flexible beading is sometimes used to trim car upholstery.
Bellypan: A partial or full surface, usually of sheetmetal, affixed to the underside of a car body. The bellypan acts as an aerodynamic aid.
