In this election cycle, 32 circuit judges and seven county judges retained their seats when no one chose to run against them.

Perhaps the most high-profile open circuit contest pits former Miami-Dade School Board member Renier Diaz de la Portilla against Miami assistant city attorney Veronica Diaz.

Diaz de la Portilla, 43, hails from a prominent political family and has served stints as a member of the Miami-Dade School Board, the last ending in 2012. He also served two years as a Florida House representative between 2000 and 2002.

He touts endorsements from politicians such as Miami-Dade Mayor Carlos Gimenez, Hialeah Mayor Carlos Hernandez, and former judges Israel Reyes and Joel Brown.

Автор приходит к выводу, что выбор кандидата – сложная задача, которую должна решить специальная комиссия по профессиональной этике. Действительно, особенность замещения вакантных должностей в США – конкуренция кандидатов. В конкурентной борьбе выявляются как сильные, так и слабые качества номинантов. Специальная комиссия и общество выбирают наиболее приемлемую в профессиональном и этическом плане кандидатуру. В России процесс назначения на должность судьи непрозрачный. В целом, судьи, вряд ли, полностью независимы, от сюда недоверие общества к судебной власти, в то время как в США доверие к суду со стороны общества, наоборот, достаточно высокое. Думаю, практика подтверждает выводы.

The text is entitled ‘Ethnic Politics, Ethics Issues Spill over into Some Judicial Races in’. The main problem of the text is that a circuit judge is elected, whose activity is public. The candidates must meet the requirements both of high ethics and competence. The author provides the following facts: Miami-Dade faces a circuit-judge election among a former politician Renier Diaz de la Portilla, an assistant city attorney Veronica Diaz, a personal injury attorney Christian Carrazana, a former Miami Beach assistant city attorney Rodney Smith. The above candidates as well as their debates are publicly being discussed. All the candidates know well not just how to live decently but how to function professionally as well as are willing to serve the society as judges. The author comes to the conclusion that choosing the right candidate is very difficult and shall be done by the ethics investigators. Indeed, the American way of taking vacancies is peculiar with competition. Society and ethics investigation are to choose the best candidate on professional and ethics viewpoints. Here in Russia appointment of a judge is not transparent. As a whole, judges are can hardly be called independent and thus in the society there is a mistrust toward the judiciary otherwise in the USA society shows trust toward courts. I think, practice proves the results.
