Broadening paragraphs or qualifying statements

Broadening paragraphs are designed to broaden the scope of patent protection and can be of 5 types:

  1. Broadening of invention features (placed before drawings)

  2. Broadening of invention variants (placed before the claims)

  3. Broadening of terms (placed after drawings, or scattered in the detailed description)

  4. Broadening paragraph at the end of British claims.

  5. Qualifying statements intended to broaden definite features of the invention (scattered along the whole detailed invention).

Examples:

While I have illustrated and described two preferred embodiments of my invention it is to be understood that such are merely illustrative and not restrictive and that variations and modifications may be made therein without departing from the spirit and scope of the invention. I therefore do not wish to be limited to the precise details set forth but desire to avail myself of such changes as fall within the purview of my invention.

As will be readily apparent to those skilled in the art, other process steps may readily be altered, combined or otherwise modified within the scope of the present invention.

The term "demineralised water" is used herein for convenience and is to be understood as including distilled water, pure condensate from steam derived from a steam generator, or any other water from which, when it is evaporated, there will be virtually no solid deposit.

Термин «обессоленная вода» используется здесь лишь для удобства и означает дистиллиро­ванную воду, чистый конденсат пара, полученного в парогенера­торе, и любую иную воду, при испарении которой практически не остается твердых остатков.

Detailed description

The detailed description of the invention is the meatiest section of a patent. Its purpose is to adequately and accurately describe the invention. There are generally two sections:

  • A general explanation of the invention and how to practice it.  The invention is described in its broadest sense, to show that the inventors have a broad view of the scope of the elements. Often, preferred embodiments of the invention are described. Such embodiments are generally more limited versions of the broadest concept and are provided for support for a fall-back position of narrower claims if the broader concept is not patentable. Definitions of key terms are often provided and are extremely important in interpreting the scope of the claims.

  • Specific examples of how to practice the invention.  A patent application does not require examples, however in practice, examples can often assist in showing patentability (e.g., enablement). The examples may or may not have been performed by the inventors. "Working" examples present completed undertakings. "Prophetic" examples are hypothetical undertakings and are always written in the present or future tense. Typically, the examples demonstrate practice of one or more specific embodiments of the invention.
