Indemnification vs indemnity
Следует отметить, что оба слова переводятся как возмещение убытка, компенсация. Однако indemnity может означать гарантию возмещения убытка.
Average
Термин, означающий частичную аварию в морском страховании (от франц. avarie- авария, ущерб, повреждение) При общей аварии (general average) убытки, возникшие в результате преднамеренных действий владельца судна, делятся между всеми заинтересованными сторонами (владельцами судна и груза). При частной аварии (particular average clause), убытки, возникшие в результате несчастного случая, несут владельцы утраченного или поврежденного имущества.
Average adjuster, average adjustment
В страховании average adjuster – диспашер- специалист в области международного морского права, составляющий расчет диспаши (average adjustment), т.е. расчет убытков и их распределение между судном, грузом и фрахтом.
4. Assessor
В страховании assessor – оценщик- лицо, определяющее величину потерь. Оценщик- это независимый эксперт или фирма в отличие от специалиста по претензиям из числа служащих страховщика.
5. Underwriter
В страховании underwriter (андеррайтер)- лицо, которое определяет риск, выносит решение о целесообразности и возможности его страхования и рассчитывает величину требуемой страховой премии на основе частоты предъявления требований выплаты сумм по аналогичным рискам в прошлом. Название «андеррайтер» восходит к временам первых шагов развития морского страхования, когда купец в качестве третьей стороны ставил (write) свою подпись под (under) суммой и слагаемыми риска, который он согласен покрыть.
6. Interest
Данное слово может представлять определенную сложность при переводе, поскольку имеет несколько значений, в том числе:
- процент, процентный доход;
- доля, участие в капитале компании;
- заинтересованные лица; группа лиц, объединенных общими интересами, в том числе деловыми;
- объект страхования и т.д.
При выборе наиболее подходящего значения следует опираться на контекст.
