Reply to Complaint about Delay in Submiting Technical Documentation
Dear Sirs,
We acknowledge receipt of your letter of September 5, this year, from which we have learned that you make a claim on us for the sum of... dollars for the delay in submitting the technical documentation under Contract No...
We have carefully studied your claim and must inform you that the delay in submitting the technical documentation occurred through no fault of ours. We would like to remind you that Article 6 of the above contract provides for the submission of the technical documentation within three months after you open an irrevocable letter of credit in our favour with the Bank for Foreign Trade of Ukraine for the sum of... dollars. You undertook to open the letter of credit before June 5, this year; it was actually opened by you on July 25, i.e. more than a months overdue.
Thus, you have infringed the contract in respect of terms of payment, which has caused the delay in submitting the technical documentation and consequently you cannot hold us responsible and claim damages.

Ми отримали вашого листа від 20 грудня цього року і були здивовані вашими рішеннями продовжити гарантійний період на генератор, який вийшов з ладу через дефекти заводу-виробника, лише на один місяць.
У зв’язку з цим ми хотіли б звернути вашу увагу на Статтю 7 нашого контракту, яка передбачає продовження гарантійного періоду у разі виходу обладнання з ладу з вини заводу- виробника на термін, протягом якого обладнання простоювало.
Вам, звичайно, відомо, що ми негайно повідомили Вас про вихід генератора з ладу, однак Ваші представники прибули з великою затримкою, в результаті чого генератор був запущений в експлуатацію лише через два місяці після його поломки.
Більше того, ми були здивовані Вашою відмовою повністю відшкодували наші збитки, викликані простоєм генератора.
Згідно з нашим контрактом замовник має право вимагати задоволення претензій, які виникли у зв’язку з виходом обладнання з ладу через вищезгадані причини. Враховуючи це, ми б хотіли поновити наші переговори і остаточно визначити дату закінчення гарантійного строку і вирішити питання про повне відшкодування наших збитків.
