8) We are writing to you to request you to represent our interests in what we consider to be a clear case of breach of contract.

From the correspondence enclosed you will note that "DV-Electronic Data Systems Deutschland GmbH" have failed to comply with the terms set out in our Contract of Sale (see enclosure), where­by delivery of the goods in question (viz 400 VGA Monitors, Type MultiSync XL) was assured by 15th January 20..

We finally took delivery of these articles on March 10th, by which time we had incurred considerable financial losses and were obliged to supply our customers at 25% under list price. We have already deducted out losses from the invoice amount + 10% administration charges and transferred the amended invoice amount to DV-Electronic's account. We have, in addition, can­celled a further order (see enclosures) for 400 key­boards. DV-Electronic, however, are insisting upon a list-price settlement and have indicated that they will not accept our cancellation. They have also passed the matter on to their solicitors, who have threatened litigation, should we fail to honour our order for the keyboards.

We welcome your comments on this matter and would be most grateful if you could act in such a manner as to convince DV-Electronic that any further attempt to press their claim would prove futile.

As requested at the Board meeting of 18 April, here is my report. The full report is attached as a Word document, but I have written a brief summary below.

Introduction
