План

1. Інтелектуальні витоки «прав людини»: гуманістична традиція в історії західної політико-правової думки доби Античності та Нового часу.

2. Теорія гуманітарного втручання.

Методичні рекомендації

Висвітлення інтелектуальних витоків концепції прав людини вимагає звернення до гуманістичної традиції в історії західної політико-правової думки доби Античності та Нового часу. Насамперед слід розглянути гуманістичні погляди давньогрецьких софістів, визначити зміст їхньої критики тогочасних соціальних норм (звичаїв, традицій, юридичних законів) та обґрунтування ними природної рівності людей. Особливу увагу треба приділити зародженню та оформленню концепції прав людини в рамках лібералізму у XVII-XIX ст. зусиллями Г. Гроція, Дж. Лока, Ш. Монтеск’є, С. Пуфендорфа, Т. Пейна, І. Канта. Необхідно розкрити у їхніх поглядах зв’язок ідеї прав людини з ідеєю становлення мирної, заснованої на праві, організації міжнародного життя.

У другому питанні потрібно розкрити основні положення теорії гуманітарного втручання, розглянути історичні передумови її практичного застосування у сучасній світовій політиці. Слід з’ясувати, як прихильники цієї теорії (Л. Ексуорсі, В. Зартман, Л. Ріннер, Г. Саламе та ін.) ставляться до дилем співвідношення суверенітету держави та прав особистості, національної безпеки та людської безпеки, які, на їхню думку, механізми забезпечення прав людини у міжнародних відносинах є найбільш ефективними.
