- Что такое коллегия (суд) присяжных?
- В настоящее время коллегия присяжных состоит из 12 человек, обыкновенных людей без специальных знаний, выбранных наугад, для выполнения функций беспристрастных судей при рассмотрении дела в суде.
- Каковы функции суда присяжных?
- Во время процесса судья, участвующий в рассмотрении дела, консультирует коллегию присяжных о правовой норме применительно к данному делу (разъясняет смысл закона). Поэтому функции присяжных – применение закона к рассматриваемому делу и вынесение решения о виновности или невиновности подсудимого (обвиняемого) при рассмотрении уголовного дела. А при рассмотрении гражданских дел присяжные должны определить, подлежит ли ответственности обвиняемый (подсудимый) перед истцом. При рассмотрении гражданских дел присяжные определяют размер понесенных истцом убытков (сумму убытков истца).

Who wants to be a millionaire?
Since making its debut in September 1998,’ Who wants to be a millionaire?’ has become worldwide hit. Four people have become millionaires (legally), seven have walked away with 500,000 and seven have walked away with nothing.
On 10th September 2001 Charles Ingram became one of those lucky (and intelligent) people who won the big prize – a million pounds. So why, when he returned to the dressing room, did he have an argument with his wife? Why did he not celebrate? It was because they cheated, and they were nervous about being caught.
When the truth was revealed, nineteen months later, they were caught. During the show which Ingram won, viewers heard someone coughing regularly. It was a college lecturer friend of theirs, Tecwen Whittock. He was in the studio, and every time he heard the correct answer, he coughed. Ingram never admitted cheating, but viewers who saw the show said that the cheating was obvious. On some occasion Ingram actually changed his answer after coughs from Whittock told him he was wrong. A doctor later said that Whittock suffered from an allergy that was making him cough. But the 15.1 million people who watched a replay of the show on the later documentary, had other ideas.
Charles, his wife, and his friend were all found guilty of cheating and ordered to pay fines totaling 40,000. Luckily for them, when they were sentenced, they were not sent to prison because of their young families and good jobs.37

Суд присяжных всегда играл в Англии важнейшую роль в системе правосудия. Коллегия суда участвует в заседании и принимает решение, исходя из фактов. Во главе суда стоит судья, имеющий юридическое образование. В его функции входит следить за правильным ведением процесса, информировать присяжных о законе и тех вопросах, которые они будут решать. В уголовном деле присяжные определяют лишь виновность или невиновность подсудимого. Если присяжные выносят вердикт о виновности, судья определяет наказание. В гражданских делах присяжные не только решают, виновен ли подсудимый, но и определяют сумму, которую он должен уплатить.
Присяжные не обязаны объяснять свое решение. Если судья не согласен с вердиктом, он может предпринять определенные шаги, чтобы его отменить. Но он не может сделать это в случае, если подсудимый признан невиновным. Это последнее слово.
