В последнее время при употреблении предлогов «in» и «under» со словом «circumstances» не прослеживается четкая, а, главное, однозначная тенденция. Отдельные справочники по словоупотреблению предлагают следующее:
а) in the circumstances – в обстоятельствах (т.е. существуют некие обстоятельства):
