Employment Law

1. Employment protection legislation
The Employment Protection (Consolidation) Act 1978 (EPCA78) as amended by the Employment Acts 1980, 1982, 1988 and 1989, the Trade Union Reform and Employment Rights Act 1993 forms the main legislation governing employment and redundancy rights of employees in the UK.
Under the EPCA an employee is an individual who has entered into or works under a contract of employment.
A contract of employment is formed as soon as a job has been offered and accepted in return for financial consideration. The terms may be stated at an interview or in a letter offering or confirming the offer of a job, or they may be implied into the contract by custom or practice or by common law.
Under the Trade Union Reform etc. Act 1993 the employer must give a new employee who works at least 8 hours a week and whose employment lasts for at least one month written details of the main terms and conditions of employment within the first 2 months of employment. The statement must cover the names of the employer and employee; the date when the employment (and the period of continuous employment) began, remuneration and the intervals at which it is to be paid; hours of work; holiday entitlement; job title or brief job description, where it is not permanent, the period for which the employment is expected to continue or, if it is for a fixed term, the date when it is to end; either the place of work, or if the employee is required or allowed to work in more than one location, an indication of this and of the employer’s address; the details of the existence of any relevant collective agreements which directly affect the terms and conditions of the employee’s employment. The Act entitles employees to be given individual written notification, as soon as possible and in any event within one month, whenever a change is made to one of the matters required to be covered in the statement. The statement will have to include a note containing details of the employer’s disciplinary and (except in firms with fewer than 20 employees) grievance procedures, and stating whether or not a pension contracting-out is in force for the employment in question.
