Conclusion

The law has already made much: the psychology of heads is reconstructed; there is an elimination enterprise-favorite. Law of Kazakhstan “About bankruptcy” became original "guillotine" above directors of the unprofitable enterprises. It stimulates careless heads to work better, to find a way out of impasses to adapt to market economy. The law stimulates occurrence of greater number of managers of the maximum class, young, vigorous, competent, capable to supervise over the enterprise in market conditions. The law, it is possible to tell, put things in order in present, apparently, a desperate situation. It gives hope for revival. Bankruptcy the enterprise does not mean bankruptcy of economy. Curing the separate enterprises, we treat also all economy as a whole.

During bankruptcy of the insolvent enterprises there is a set of questions. In particular, during realization of procedures of bankruptcy at sale of property complexes (competitive weight) competitive managing directors are guided by Law of Kazakhstan "About bankruptcy" and basically Governmental order of Kazakhstan from 8/11/2011 of year N 759 "About the statement of rules of reselling preparation and sale of property (actives) of the liquidated organizations recognized by bankrupts under the initiative of the state". It is necessary to note, that in their Rules the starting prices are established at the Dutch method, equal to estimated cost of property (actives) liquidated the organizations and at an English method of the tenders - not below the sum of requirements of the first and third turns of creditors. Practice of carrying out of procedures of bankruptcy has shown, that sale of property complexes (the basic lots) is spent in the majority on the Dutch method under very low prices that is not enough for satisfaction of requirements even on wages.

It is supposed, with a view of protection of interests of exclusive creditors of the first, third and fourth turn, to fix a floor price of the tenders at sale of a property complex (actives) on the Dutch system of the tenders on the core lot and to establish it in view of requirements of creditor debts under taxes in the budget. Also the above-stated Rules it is necessary to provide in case of insufficiency of means from realization of a property complex of the liquidated enterprise of the obligation of the buyer on satisfaction of debts under taxes in the budget in coordination with the authorized representatives of such creditors. The given offer will allow really profitable part of the budget from sale competitive weights of the liquidated enterprises of republic.

Civil Code of Kazakhstan (clause 51) and Law of Kazakhstan "About bankruptcy" (clause 77) in case of a recognition of the enterprise the bankrupt stipulates definition and payment of requirements to citizens which the debtor bears the responsibility for causing of harm of a life and to health by charge (at date of a recognition of the debtor the bankrupt) capitalizations of the corresponding time payments which are a subject payment to the citizen before achievement by it of seventy-year age, but not less than for ten years (the first turn).

During realization of procedures of bankruptcy the establishment of the size of requirements of creditors of the first turn is made according to "Rules of compensation by the organizations of all patterns of ownership of the damage caused by a working serving mutilation or other damage of health, connected with execution of labour duties by them" from March, 17th, 2012 N 201.

As is known, the volume of the sum of requirements of creditors of the first turn consists of the sum of requirements of creditors of the first turn consists of the sum of the basic duty formed for date of a recognition of the enterprise by the bankrupt and added during competitive manufacture of capitalization according to the above-stated Rules.

At the same time, according to item 3 of clause 943 of Civil Code of Republic of Kazakhstan (an especial part) in case of when capitalization of payments cannot be made in a kind of absence or insufficiency of property at the liquidated legal person that was given the sums are paid to the victim by the state by way of, stipulated by acts.

In this connection:

- First, it is necessary to improve legislative and normative base in republic which are adjusted with the order of charge and payment of requirements of creditors of the first turn before which the debtor bears the responsibility for causing of harm of a life and to health;

- Secondly, the added sum of capitalization is expedient for accumulating completely in the state budget or social funds and to carry out payments periodically (monthly) with the installments for the period before achievement by the citizen of seventy-year age, but not less than ten years.

The specified offer on conditions of payments of capitalization of citizens will enable the state to increase receipts in the budget and allows to use their account part of the budget.

At realization of procedures of bankruptcy, there is a serious problem concerning such enterprises on which there are the chemical elements applied in production and a withdrawal of manufacture, hazardous to health and lives of citizens, environments.

According to Law of Kazakhstan "About bankruptcy", obtained from realization of property of the bankrupt of means go on repayment of creditor debts in strictly established sequence. The bankrupt has no other financial assets and has no opportunity to finance works to observance of ecological requirements on storage, transportations, to use, recycling, removals and burial places of chemical and radioactive materials, and also to not suppose infringements of specifications of a maximum permissible level of radiating environmental contamination. Though, according to clause 52 of Law Kazakhstan "About preservation of the environment" carrying out of check ecological the condition of the enterprise and other object is assigned to the body which is carrying out sanitation, or external management.

In case of a recognition the bankrupt and its subsequent liquidation, there is unresolved a question of definition, the sanction, accommodation and an establishment of assignment of mobilization capacities and a reserve which are the inviolable state, mobilization reserves which are not entering into competitive weight.

Law in force of Kazakhstan "About defense and military forces of Republic Kazakhstan" , "About a civil defense " and "About bankruptcy", is not provided the order of accommodation of a mobilization reserve at bankruptcy, liquidation and sale of the enterprise to other proprietor, and also the confidential documentation of constant storage.

Also it is necessary to note that the analysis of probability of bankruptcy gets value of one of the basic regulators which subjects use as means of influence for the financial processes occurring at the enterprise. There is a set of various methods of an estimation of probability of bankruptcy. It is necessary for enterprise to choose one or reasonably to combine a little from existing methods, to receive a picture of solvency of the enterprise.

At carrying out of the analysis of bankruptcy of the enterprise it is possible to find out the reasons of possible bankruptcy that will allow to avoid it in the future. The reasons can be, as above, decrease in sales volumes because of bad studying demand, absence of a marketing network, advertising already was spoken; decrease in volumes of manufacture; unfairly high expenses; low profitability of production; too big cycle of manufacture; greater debts, mutual non-payments, etc.

Therefore the great value gets knowledge the bookkeeper of the enterprise of bases of calculation of solvency and the analysis of probability of bankruptcy, and also the normative base adjusting questions of bankruptcy of the enterprise.

Estimating current position of bank in the financial market of Kazakhstan, and defining long-term plans, it is possible to speak with confidence about the optimistic forecast of the further development of joint-stock company "Halyk Bank of Kazakhstan" as one of the largest banks of the country means the near future and long-term prospect.

The national bank is the universal bank offering to the clients all kinds of bank service. The bank sees the clients among all groups of the population, the companies, the enterprises and establishments of all patterns of ownership in all branches and spheres of a national economy, financial institutions and structures of the state administration. The bank is aimed at an establishment of strong and long-term partner attitudes with all clients and to aspire to the maximal satisfaction of their needs for high-quality bank services and products. Realization of the put strategic problems will allow Halyk Bank of Kazakhstan to provide qualitative updating of activity by the end of the planned period. Despite of expected growth of a competition, strengthening of penetration on home markets of the foreign banking capital and continuation of processes of redistribution of the markets, Bank again will take in the lead positions in the basic financial markets.

Actives of National Bank have grown in comparison with 2005 on 55 % and have made 1 567 239 billion tenge. Obligations of Bank have reached 142,5 billion tenge (growth of 38,8 %), due to increase in depositary base - means and deposits of clients up to 473,1 billion Own capital on the beginning of 2008 has made 1 412 895 83 million tenge, having increased on 2,7 %.

Opportunities of development of credit activity of Bank will be provided besides it by increase in inflow of urgent deposits of legal persons and use involved on the international financial markets, concerning cheap resources. The credit portfolio of Bank (gross) will make, approximately, 196 billion tenge. In accommodation of credit resources the Bank will be guided still by the companies and the enterprises with preservation of a high share of credits to small and average business. Considering market tendencies and development of system of card crediting, a share of credits to the population will grow, but will not exceed 12-13 %.

The basic direction of realization of the developed strategic problems should become increase of efficiency of activity of Bank due to improvement of quality and profitableness of actives, activization of work with problem credits, strengthening of diversification a credit portfolio.

Essential value for increase of financial results will have reorganization retail and increase of profitableness of corporate business, increase in sales volumes. Maintenance of profitableness of a credit portfolio at the planned level, decrease in charges on reservation, increase of a level of not percentage incomes due to expansion of volume of accompanying services will promote growth of efficiency of activity of Bank. On decrease and prevention of possible financial losses measures on increase of a management efficiency and creation of a complex control system by risks will be directed also.

At realization of the given problems the Bank will have an opportunity in conditions of decreasing rates considerably to increase the financial results and to achieve increase of feedback on actives and the capital. The comprehensible level of profitableness will be provided. On the average return on the share capital will increase up to 21-21,5 %. It will lead to improvement of image of Bank in opinion of potential investors and will provide corresponding growth of the capital.

As a whole the planned period under condition of the decision of tasks in view can be characterized as the period of restoration of the lost positions, as a preparatory stage to the further expansion of its activity, as bank with steady image, with wide presence in the international markets and at defining influence on home markets

Management of risks often connect with management of the finance. The decisions accepted during planning of management by the finance, essentially influence financial risks in which it is possible to allocate some components to which it is necessary to pay attention:

1. Sufficiency of the capital - maintenance of a sufficient level of the capital for the decision of strategic problems and performance of requirements by the regulated bodies;

2. Quality of actives - minimization of the losses resulting investment or credit activity;

3. Liquidity - availability of inexpensive means to satisfaction of current needs of business and so on.

Necessity of centralization of management of all kinds of risks in the uniform block, creation of complex system of their monitoring and management that will allow Halyk Bank to solve successfully problems of percentage, price and course policy is obvious now, to improve the mechanism of regulation of credit risk and as result to raise a level of management of actives and passives. The first step in the given direction is already made, - the Department of the analysis of financial searches is created, the program is developed and the methodology of an estimation of risks is approved. The basic purposes, directions of activity and feature of the system organization above which perfection it is necessary to work in the near future are at the moment certain.

The Halyk Bank of Kazakhstan has a unique filial network, however, costs on its maintenance now are high enough, that essentially influences profitableness of operation of Bank.

In this connection the Bank hopes, that unification of bank products undertaken now with use of the newest technologies will allow to consolidate expenses and to lower term of their recoupment, will create unique conditions for an exchange and introductions due to an opportunity of wide duplicating on places. Introduction diversified the standard of administrative expenses, probably, through association of branches, but without reduction of their number is actual.

Halyk Bank of Kazakhstan plans to reconstruct organizational structure of bank in a direction of increase of flexibility of management, optimum distribution of powers and focusing of work of divisions on growth of financial results. Having kept the centralized management of questions of strategic development, structural policy, management of risks, it is planned to expand powers of branches and the divisions directly working with clients due to what to overcome complexities of management of a filial network of the Bank, caused with significant geographical branching; to limit influence of the factors reducing efficiency of acceptance and use of decisions, to achieve optimum balance of distribution of functions and powers between structural parts of a control system.

The organizational structure and filial network will be optimized in view of regional features and needs of clients. It is differently planned to modernize structure of bank, having made its mobile to try to avoid functions of duplication and at the same time to toughen control functions.

We undertake measures to revision of an estimation of qualification of the personnel, it is required to lift a professional level of employees of branches and an initial part. Unfortunately, at the moment, systems of moral and material stimulation, motivation of the personnel that creates risk of loss of the perspective staff are insufficiently effective and can lead to unjustified expenses for preparation and training. The management of bank plans to change a similar situation radically.

Planned further development of card payment system, that area where the National Bank is the recognized leader, In a direction of stabilization of work and expansion of number of offered new card products will allow to strengthen in the lead position of bank even more.

In the international activity carrying out of more aggressive competitive policy in the near future is planned. The declared increase of a level of capitalization of bank, certainly, will help National Bank with achievement of the objects in view, nearest of which is attraction of the syndicated loan. Among the basic partners on international scene the National Bank sees first of all such the largest multinational financial institutions as the European bank of reconstruction and development, besides the National Bank actively uses a more potential of cooperation through participation in programs on support small and average business, trading financing, the grain receipts, the largest commercial banks of the Europe, the United States, Asia.

Alongside with attraction of financing in the international market of capitals lengthening of terms of attraction of means, decrease in a total cost of resources is planned, with the purpose of expansion of resource base for increase in active operations, to optimize structure of the involved resources on parameter "the price - term - risk of reassessment".

For increase of appeal of the services, the Bank will offer connection of supplementary products with credit and insurance, the combined schemes directed on satisfaction of needs of investors in habitation, large purchases, payment of formation, tourism and rest will be developed, differently the bank plans to use not percentage levers for a raising of appeal of the depositary products.

By granting financing and crediting the special attention is planned to give consultation and rendering of additional services to clients of Bank. All above listed are directed on development of long-term partner attitudes with clients also will allow to reduce risk of fluctuations of the rests on accounts of corporate clients, to make their more predicted and planned.

As Kazakhstan has no such wide experience in sphere of the finance as a whole, it is difficult to it to struggle sometimes with economic problems. But nevertheless the confidence of achievement of all set forth above purposes installs huge, up to the end not used potential of bank, presence of the differentiated client base, amicable highly professional collective. It is necessary to consider also a favorable investment climate in Kazakhstan, appeal of our economic model to an investment of investments. Steps planned by bank in this connection, it is quite possible to consider as the mediated investment projects as finally financial streams will be directed directly to real sector of economy of Kazakhstan.
