2 Analysis of inflation and its impact on money turnover in kazakhstan

2.1 Legal frameworks for inflation

In a market economy, price is the key to efficient operation , as business entities and consumers . In view of this legal regulation of pricing and pricing policies of the state are paramount in solving economic and social problems , including limiting inflation.

In accordance with the Constitution of the Republic of Kazakhstan principles of pricing policy within the exclusive jurisdiction of the Republic of Kazakhstan , which requires the adoption of a federal law defining its basic principles . Legislative definition of the procedure for establishing and regulating prices by authorized state bodies also requires the Civil Code of the Republic of Kazakhstan .

In the current state policy of prices and pricing procedure regulated natural monopolies . In addition, there are state-controlled prices for defense products and orthopedic products , payment public housing , community , ritual and social services, price premiums for drugs and medical products , paid medical and epidemiological services , prices baby foods and some others.

Lack of a comprehensive law on pricing " compensated" by a variety of other laws and regulations . It is more than 30 laws , presidential decrees and dozens of resolutions of the Government of Kazakhstan , at the regional level, they are supplemented by regulations (ordinances ) RK subjects and local authorities . In all this is difficult to understand even for an expert .

Even worse situation with pravoobespecheniem control over prices regulated by the government . Recently, the President of the country and a number of politicians have repeatedly expressed concern about the increase in prices for socially important goods , especially medicines. However, in pricing for the major kinds of products, as well as socially significant products (services ) there is no normative regulation of monitoring the implementation of legislation , and price control bodies operating in all regions of Kazakhstan , have no authority to conduct inspections , sanctions for violation of the controlled State prices.

Only the currently valid legal act - Presidential Decree , under which enterprises and organizations that have violated the norms of the legislation on the state regulation of prices (tariffs ) apply sanctions in the form of penalties throughout the amount of excess revenue received and a fine of the same amount . The new Code of Administrative Offences installed fine on legal entities in the amount of 400 to 500 times the minimum wage .

Consequence of the establishment of the state regulation of prices is an income limit , which can be obtained as a result of the production (sale ) of certain types of products (services) . Violation of state price discipline leads to income from other persons whose interests are protected by the state , limiting the price. Since collecting the entire amount of excess revenue received does not apply to fines for administrative violations , the use of such sanctions in accordance with the requirements of the Civil Code must be established by applicable law .

Causes of price laws are subjective and objective. The objective is the absence of a unified concept of state pricing policy , the presence of many of the laws and regulations governing individual pricing issues . One of the main reasons is the lack of subjective legal regulation of pricing and control activities .

Legality in the field of price control could be achieved by introducing a uniform legal norms , criteria and standards for state regulation of prices , as well as functions of public authorities responsible for supervising the implementation of the legislation on the regulation of prices .
