What are torts?

Torts are civil wrongful acts that result in injury or harm inflicted by one person (tortfeasor) to another person. The injured person will sue the tortfeasor for this wrong and will file a suit seeking damages.

How does tort law protect people and community?

Tort law covers a wide variety of injuries. Society recognizes an interest in personal physical safety, and tort law provides a remedy for acts causing physical injury or interfering with physical security and freedom of movement. Society recognizes an interest in protecting property, and tort law provides a remedy for acts causing destruction or damages to property. Society recognizes other, more intangible interests in such things as personal privacy, family relations and reputation. Tort law provides a remedy for invasion of protected interests in that area.

What is the function of tort law?

Thus the function of tort law is to provide the injured party with some remedy imposing liability for the wrongful act on the tortfeasor.

What are the categories of tort law?

Torts are divided into the following three categories: 1) Intentional torts; 2) Negligence; 3) Strict liability.

What are the main provisions that define each category?

Intentional torts are those wrongs which the defendant knew or should have known would occur through their acts or omission of acts. Negligent torts occur when the defendant's actions were unsafe. Strict liability wrongs do not depend on the degree of carefulness by the defendant, but are established when a particular action causes damage.

What kind of relief is the injured party awarded by the court?

In a tort case a claimant (plaintiff) brings an action against the defendant and they both provide facts and evidence. The one who manages to prove his or her case wins and is awarded damages.
