Если права гражданина были нарушены, он имеет право обратиться в суд. Судебная ветвь власти независима и отделена от законодательной и исполнительной ветвей. Суды штатов, федеральные суды и Верховный суд США выносят решения, имеющие обязательную юридическую силу.

Несмотря на это, США печально известны из-за высокого уровня преступности. Суды не в состоянии сбалансировать права отдельного гражданина и общества в целом. Помимо прочего, это относится к правам подозреваемого в уголовном преступлении, которые нарушаются, несмотря на специальные процедуры допроса и возможность рассмотрения дела беспристрастным судом присяжных.

Смертная казнь как средство сдерживания преступности (устрашения) также вызывает вопросы у многих членов общества. Все это осложняет работу судов и сотрудников правоохранительных органов.

Так как тюрьмы переполнены заключенными, в их отношении используется условно-досрочное освобождение. Так преступники снова попадают на свободу. Поэтому многие обыватели выступают в пользу ослабления законов о контроле над оружием, чтобы бороться с преступностью. Суды присяжных обычно оправдывают тех, кто использовал оружие с целью самообороны.

3. Role play (see Part b, pp. 116-124).

Role 1. You are an average American – white, middle-aged and Protestant. You believe that as you represent the majority, you are the only real American and can decide the fate of minorities.

Role 2. You are a Native American (see p. 116). You are convinced that it’s you who are the true owner of this land and oppose living in a reservation.

Role 3. You are an Afro-American (pp. 117-119). You take pride in being black and want to put an end to the dominance of the white in all sphere of life in the USA. You still feel a prejudiced attitude in the society.

Role 4. You are a Mexican (pp.120-121). You think that Hispanics remain the most underprivileged social group and you doubt that the society is progressing toward a better attitude to fringe groups.

Role 5. You are an elderly person (pp.122-123). You want to take a more active part in the life of the country and don’t want to feel a social outcast. You call for more elderly people communities to be arranged throughout the country and oppose the opinion that the elderly are good for nothing.

Role 6. You are a convinced smoker (p.124). You have started to feel as a persecuted minority in the health conscious society. You think that numerous anti-smoking campaigns are an intrusion into privacy and violation of your rights.

Roles 7,8. You represent other fringe groups. You call for more respect for your rights and want to have more say in the matters of social life.
