3. Statement of Sea Protest by tankers

Amsterdam, 17th May, 20 . ..

To the Notary Office,

Amsterdam, Holland.

STATEMENT OF SEA PROTEST

I, Pyotr Ivanovich Ivanov, Master of the m/t "Elbrus", sailing under the Ukrainian flag, owned by the Black Sea Shipping Company, Odessa, and classed by the Register of Shipping of the Ukraine.

G.R.T. 8,200 tons, on the 1st of May, 20 . . ., sailed from the port Batumi, Ukraine, bound for Amsterdam, Holland, having on board 10,000 tons of Gasoil loaded in compliance with the Load-Line Ce tificate, and arrived at the above said port of Amsterdam this 17th day of May, 20 . . ., at 8,00 a. m. receiving pratique at 11.00 a. m. on the same day.

On the 8th, 9th, 10th and 11th of May, 20 . . ., we encountered very heavy weather with North -Easterly winds of whole gale force and high sea. During this period the vessel was pitching, rolling and labouring, heavily, shipping very heavy water Fore and Aft, the ship's expansion trunkways and pipelines being continually awash.

Water and air temperature during that time were changing considerably, falling and rising 5-12 degrees Centigrade. In con­sequence of these temperature changes I fear possible damage to the cargo owing to intensive sweating on the metallic surfaces and to the resultant increase of water content.

I, the Master, and the crew have applied all means of safeguard­ing the vessel and the cargo.

I declare this Sea Protest in the event of any damage to the vessel or the cargo through stress of weather conditions during the voyage, reserving the right to extend the Protest at time and place con­venient.

4. Wording of some other reasons for noting a Sea Protest

1) . . . During the voyage, on the 21st May, 20 . . ., spontaneous combustion of Cotton in Hold No. 2 took place. The fire was extin­guished by the ship's fire-fighting equipment. Several bales of Cotton were damaged by fire, while some more cargo may have been dama­ged through possible wetting.

Owing to the above mentioned tire on board my ship I anticipate possible damage to the cargo and ship.

I hereby give notice of my intention of protesting against all losses and damages, reserving the right to extend my Protest at time and place convenient . . .

2) . . . During the voyage, on the 11th April, 20 . . ., the ship entered the area of thick fog and while drifting got stranded on a bank. The ship refloated without any assistance by pumping out the ballast water and proceeded on her voyage, no evident damage to the hull or machinery and no leakage being found.

Owing to the above mentioned occurrence I apprehend possible damage to the cargo ol Lubricating Oil through leakage or contami­nation with salt water.

Therefore, I give notice of my intention of protesting against all losses or damages to the ship or cargo in consequence of the afore­- said occurrence ...

3) . . . During the voyage, on the 6th of May, 20 . . ., my ship colli­ded in fog with some other ship, no serious damage being caused to both vessels.

Owing to the above mentioned collision I anticipate possible contamination or mixing of different grades of the cargo which may have ensued from loosening or deformation of bulkheads and resul­tant leakage.

Therefore, I give notice of my intention of protesting against all losses and damages, reserving the right to extend my Protest at time and place convenient . . .
