We have received your telexed reply of 3rd April concerning our claim in connection with the inferior quality of the gas turbines delivered by you against Order 45/0121 of 1st December last year. From the telex we are surprised to learn that you have declined our

claim as groundless stating that the gas turbines were tested at your

works and the Test Report indicates that the gas turbines are in full

conformity with the technical conditions of the order.

We cannot agree with your decision for the reasons listed below. We waived the inspection and the gas turbines were released for shipment on the basis of the Works Test Report. In accordance with the conditions of the Order since our inspectors did not take part in the tests at the manufacturing works, our Customers have the right to test the equipment at their compressor stations. When the gas turbines were installed and tested, it turned out that a number or alterations had been introduced into the control system of the gas turbines without their consent. They had not even been informed of it. The capacity of the gas turbines proved to be lower than that provided for by the technical conditions of the Order.

In the circumstances we either have to refer the matter to the Arbitration Court at the USSR Chamber of Commerce and Industry whose award will undoubtedly be in our favour or there may be an alternative: we could retain the substandard equipment if you granted us a 15 per cent allowance.

In view of the above and as the results of the tests do not satisfy us we want our inspectors to take part in the tests of the balance of the gas turbines at your works. Please let us know when the remaining equipment against the above Order is ready for inspection. We are looking forward to hearing from you soon.

Further to our telex of 2nd March and our yesterday's telephone conversation with Mr Grant we have to inform you that unfortunately we cannot accept at the prices given in your Invoice the last lot of Coffee which arrived on board "Brazil" against Contract No 32/042.

The quality of Coffee proved to be inferior to that of the sample the basis of which the Contract was concluded.

Also, we have to point out that the goods were shipped with a delay of four weeks and we are entitled to get from you a penalty the amount of which will be calculated and deducted from your Invoice, (to be continued) (continued) Mrs Corn

In case of your refusal according to Article 8 of the above Contract we shall have to take drastic measures and submit our claim for arbitration.

TEXT 17 B. ENVIRONMENTAL PROTECTION

It is better to cooperate with nature than to fight her. In other words let us not combat our environment, let us adjust ourselves to it.

Here is an extract from the Long-term Programme for the De­velopment and Deepening of Trade, Economic, Industrial. Scientific and Technical Cooperation between the Union of Soviet Socialist Republics and the Republic of Finland till 199...:

"VII. Cooperation in the Field of Environmental Protection

Taking into consideration that the protection of environment against pollution, as well as the localization and removal of pollutants already formed, is one of the most important tasks of the present days, the Parties shall continue and develop their cooperation on the protection of environment and nature. In so doing they shall pay special attention

lo planning measures for environmental protection and for the development of technologies and cooperation in this field.

The Parties consider it important to develop this cooperation especially in the fields of the pulp-and-рарег and chemical industries, collection, transportation and treatment of waste in populated localities, construction, the water economy, land use and agriculture.

In this connection the Parties consider as promising the following types of cooperation:

planning joint measures intended to prevent the pollution of the air, "land, water reservoirs and the Baltic Sea:

working out safety measures for the transportation of goods

dangerous to the environment;

developing technologies for purifying stations and of purifying

equipment for drinking water and sewage;

developing technologies for the collection, transportation and treatment of waste with a view to lessening the waste-caused damage to the environment; purposeful use of waste;

improving sound insulation in buildings to prevent noise and

also thermal installation to save energy;

working out more efficient, from the viewpoint of nature and

environmental protection, logging machinery and equipment and methods for logging;

developing ecologically advisable crop farming methods and cattle breeding technologies so as to prevent eutrophication of water reservoirs and deterioration of the quality of underground waters;

protecting reserves of the disappearing species of plant and

animals.

The Parties shall develop and expand contacts between their authorities in the field of protection of the environment and nature so as to exchange information and experience and also to develop and apply proven methods. The Parties recommend further development of this cooperation within the framework of the Soviet-Finnish Commission on Scientific and Technical Cooperation.

The Parties shall promote their cooperation in the said and other fields of environmental protection leading to the development of appropriate trade and economic cooperation between them, given¹ the necessary conditions and interest."

It is high time any turkey contract on construction work or for the delivery of complete plant should include an Article bn Environmental Protection and provide for purifying stations and collection of harmful and dangerous for health gas and other kinds of waste atfd either its purposeful use or means of its treatment to lessen its harmful effect on the environment and people's health.
