We are writing to you to complain about the damage to Control Fuel Unit we received yesterday against contract No. 26/15-098.
The boxes in which the Units were packed were damaged and looked as if they had been broken open in transit. From your invoice No. 76-098 we estimate that 5 (five) Units to the value of $156,098.90 have been stolen. And because of the rummaging in the boxes, quite a few other units were crushed or stained and cannot be used for the purposes intended. We are holding them at your disposal pending your instructions as to how they should be returned.
With the sale on c.i.f. basis and the forwarding company being your agents, we suggest you contact them with regard to compensation.
You will find a list of damaged and missing articles attached hereto, and the consignment will be put to one side until we receive your instructions.

Thank you for your informing us of the damage to our consignment (Inv. 76-098).
From your previous transactions you will realize that this sort of problem is quite unusual. Nevertheless, we are sorry about the inconvenience it has caused you.
Please would you return the whole consignment to us, postage and packing forward, and we will ask the Shipping company to come and inspect the damage so that they can arrange for a fair compensation. We reckon this matter should not be taken up with the insurance company.
If you want us to send you another shipment as per your Contract 76-189/356-01 please let us know. We have the Units in stock and there would be no trouble to send them within the next fortnight.

We cannot accept your claim for the following reason. As the contract was concluded on ex-works terms we cannot be held responsible for the alleged damage incurred during transportation.
We hope that you will be satisfied with this explanation and withdraw this claim.

We regret to inform you that on the arrival of our order at the port yesterday, the ship’s agent discovered that the crates containing the consignment had not been safely secured for the journey. The agent opened at random a number of crates which showed no sign of damage on the outside, and found that the contents were badly damaged. During the rough crossing, some crates were severely dented. This in turn allowed seawater to seep into them, causing irretrievable damage to the stationery it contained.
We must draw your attention to para 6 of Contract No. 90-098/678 which provides for seaworthy packing of the goods to withstand sea transportation which you obviously have failed to follow.
We immediately notified the carrier and the damage was formally confirmed by a Lloyd’s agent. His report is attached hereto.

Given that insurance policy is in your care, would you please urgently contact the underwriters to make a claim for the loss involved. Also, we should be grateful if you could arrange for replacement of the contents of crate No. 2 to be airfreighted to us as soon as possible, as we require them for the Christmas trade.
